1. Statement Of Purpose

  • We collect, use, and share aggregated data such as statistical or demographic data. Aggregated data could be derived from asset and location information as well as personal data but is not considered personal data in law as this data will not directly or indirectly reveal one’s identity.

2. Collection Of Information

    • The company collects and processes personal information/data from the following sources/with the customer’s knowledge and consent when you do any of the following (please note that this list is not exhaustive):  
      • Onboarding a tracking client
      • Onboarding a fuel client
      • Provision of a recovery or towing service for various assets.
      • Giving your asset to any of the Riverlong Yards
      • Upon repossession of an asset by Auctioneers.
      • Request marketing information to be sent to you
      • Enter a competition, promotion, or survey; or
      • Give us feedback or contact us.
      • When you ask for more information about a product or service or contact us with a query or complaint
      • You respond to or participate in a survey, marketing promotion, prize competition or special offer
      • Information we receive from other sources such as Financiers
      • When you visit any of our premises
      • When you interact with our sales agents, they may collect personal information.
    • We may also collect your information or receive your personal information from various third parties to whom you have consented and public sources including but not limited to: Corporates, Banks, Financiers, Auctioneers, credit-reference bureaus, fraud prevention agencies and business directories; court registries; companies registry, lands registry and other government registries; service providers we interact or integrate with now or in future; Integrated Personal Registration Systems, Kenya Revenue Authority and the National Transport and Safety Authority database.
  • We may also collect information about you from other publicly accessible sources not listed above. We may also collect information about you from trusted partners, not listed above, who provide us with information about potential customers of our products and services.

3. The Data We Collect

  • We may collect, use, store and transfer different kinds of Personal Data about you which we have grouped as follows:
    • Asset Location and fuel data that includes longitudes, latitudes, altitude, speed, fuel level, refills and drains.
    • Tracking and fuel consumption information about an asset that includes events on an asset, trips and violation events.
    • Contact data which includes postal address, physical address, email address and telephone numbers
    • Identity data which includes name, username or similar identifier, Identity card/Passport, and any other similar information.
    • Technical data which includes internet protocol (IP) address, your login identity data, browser type and version, time zone setting and location, browser plug-in types and versions, operating system and platform, and other technology on the devices you use to access our systems
    • Your contact with us, such as when you: call us or interact with us through social media (we may record your conversations, social media, or other interactions with us)
  • Usage data which includes information about how you use our website, products, and services
  • Marketing and communications data which includes your preferences in receiving marketing information from us and our third parties and your communication preferences.

4. How We Use Your Personal Data

We may use and analyze your information for the following purposes:

  • Processing tracking data and fuel readings for various assets.
  • Ensure security of assets under storage and ensuring appropriate check in and out.
  • Provide data to auctioneering urgency upon a recovery request.
  • Responding to any of your queries or concerns
  • Assessing suitability for products and services
  • Carrying out credit checks and credit scoring
  • To comply with any legal, governmental, or regulatory requirement or for use by our lawyers in connection with any legal proceedings
  • In business practices including to quality control, training, and ensuring effective systems operations
  • To understand how you use our products and services for purposes of developing or improving products and services
  • Preventing and detecting fraud or other crimes and for debt recovery
  • For research, statistical, survey and other scientific or business purposes
  • Provide aggregated data (which do not contain any information which may identify you as an individual) to third parties for research and scientific purpose
  • Administer any of our online platforms/websites.

5. Retention of Information

  • We store and process your personal data only as long as it is necessary to perform our obligations under the agreement with you or as long as the law requires us to store it and for business and operational purposes. This will be for seven years from the end of your relationship with us.
  • Anonymized information that can no longer be associated with you may be held indefinitely.

6. Disclosure Of Information

  • Any disclosure of your information shall be in accordance with applicable law and regulations. The company shall assess and review each application for information and may decline to grant such information to the requesting party.
  • We may disclose your information to:
    • Law-enforcement agencies, regulatory authorities/enforcement agency, courts, or other statutory authorities in response to a demand issued with the appropriate lawful mandate and where the form and scope of the demand is compliant with the law;
    • Our associates, partners, software developers or agents who are involved in delivering the company’s products and services you order or use;
    • Publicly available and/or restricted government databases to verify your identity information to comply with regulatory requirements;
    • Third parties who are service providers acting as processors, professional advisers including lawyers, bankers, auditors, and those who provide consultancy, banking, legal, insurance and accounting services;
    • Your employer whereby loan repayments originate through payroll intervention;
    • Other Credit-and Financial Services Institutes or similar institutions, to which we transmit personal data that are necessary for the performance and processing of the business relationship;
    • Any debt collection agency subscribed to us, credit reference agency or bureau, rating agency, correspondents, insurer, or insurance broker, direct or indirect provider of credit protection and fraud prevention agencies, fraud prevention and anti-money laundering agencies;
    • Your legal representative and their legal advisers, upon your death or mental incapacity;
    • Further data recipients may be institutions, for which you consented to the data transmission and released Riverlong from any liability in this regard or for which Riverlong is entitled to transmit personal data due to its legitimate interests; and
    • Any other person that we deem legitimately necessary to share the data with.
    • We shall not release any information to any individual or entity that is acting beyond its legal mandate.

7.    Job Applicants

  • Personal information provided on our data collection modes in connection with an application for employment will be used to determine your suitability for a position applied for. Your information may also be used to monitor our recruitment initiatives and equal opportunities policies.
  • Applicant details may be disclosed to third parties to verify or obtain additional information including education institutions, current/previous employers and credit reference agencies. Credit reference agencies record these searches and you can contact us to find out which agencies we used.
  • Unsuccessful applications may be retained to match your skills to future job opportunities. These are usually retained for up for 12 months but please let us know if you do not wish us to retain your information for this purpose.

8. Social Media

  • We operate and communicate through our designated channels, pages and accounts on some social media sites to inform, help and engage with our customers.
  • We monitor and record comments and posts made about us on these channels so as to improve our services.
  • We are not responsible for any information posted on those sites other than the information posted by our designated officials. We do not endorse the social media sites themselves, or any information posted on them by third parties or other users.
  • We do not give investment, tax or other professional advice on social media sites.
  • When you engage with us through social media your Personal Data may be processed by the site owner. The said procession is outside our control and may be in a country outside Kenya that may have different privacy principles.

9. Marketing

  • We strive to provide you with choices regarding certain personal data uses, particularly around marketing and advertising. We have established the following personal data control mechanisms.
  • Promotional offers from us: we may use your identity, contact, technical, usage and profile data to form a view on what we think you may want or need, or what may be of interest to you. This is how we decide which products, services and offers may be relevant to you. You will receive marketing communication from us if you have requested information or used our products and services and not opted out of receiving such information.
  • Third-party marketing: we may share your Personal Data with any third party for marketing purposes where we believe that the marketing information from such third parties will be relevant to you and where we have obtained your prior consent.

10. Opting Out

  • You can ask us or third parties to stop sending you marketing messages at any time by writing to us or logging into the relevant website and checking or unchecking relevant boxes to adjust your marketing preferences or by following the opt-out links on any marketing message sent to you or by contacting us at any time through the provided contacts.
  • Where you opt-out of receiving these marketing messages, this will not apply to Personal Data provided to us because of product or service subscribed to, warranty registration, product or service experience or other transactions.
  • You have a right to object to direct marketing, you have a right to object at any time to processing of your personal information for direct marketing purposes, including profiling you for the purposes of direct marketing.

11. Safeguarding And Protection Of Information

  • The company has put in place technical and operational measures to ensure integrity and confidentiality of your data via controls around: access control, physical and environmental security and monitoring and compliance
  • We will only retain your Personal Data for as long as reasonably necessary to fulfill the purposes we collected it for, including for the purposes of satisfying any legal, regulatory, tax, accounting, or reporting requirements. We may retain your Personal Data for a longer period in the event of a complaint or if we reasonably believe there is a prospect of litigation in respect to our relationship with you.
  • By law we must keep basic information about our customers (including contact, identity, financial and transaction data) for a minimum of seven years after they cease being customers. Our internal policy as amended from time to time may also require us to keep customer data for a longer period.
  • In some circumstances, we will anonymize your Personal Data (so that it can no longer be associated with you) for research or statistical purposes, in which case we may use this information indefinitely without further notice to you.
